Terms of Service
Effective Date: June 2026
1. Acceptance of Terms
By using OIT Harmony, you agree to comply with and be bound by these Terms of Service. If you do not agree, you must immediately cease using the platform.
2. Medical Disclaimer (Critical Safety Notice)
OIT Harmony is a clinical record-keeping and logging companion tool. It does not provide medical advice, diagnosis, or treatment. All dosing protocols, schedules, titration steps, and safety rules must be directed, customised, and approved by your child's supervising allergist or immunologist. Caregivers must exercise independent clinical judgment and verify instructions with medical professionals before administering any dose.
3. Emergency Redirection (Call 000)
In the event of a severe allergic reaction (Anaphylaxis - Grade 3 on the ASCIA scale, marked by breathing difficulty, throat/tongue swelling, persistent cough/wheeze, dizziness, or pale/floppy state), you must immediately:
- Follow your child's ASCIA Action Plan.
- Administer the adrenaline (epinephrine) auto-injector (e.g. EpiPen).
- Call emergency services (000 in Australia). Do not delay emergency medical action to enter data in this application.
4. TGA & Regulatory Status
OIT Harmony is not a regulated medical device under the Therapeutic Goods Act 1989 (Cth). It is a self-management logging tool that falls within the excluded software category under the Therapeutic Goods (Medical Devices) Regulations 2002 (aligned with the February 2026 software exclusion guidelines). It is designed to assist you in record-keeping for low-dose allergen exposure programmes under clinical supervision, but does not calculate or suggest dose titrations.
5. Accuracy of Logs & Clinician Review
Caregivers are solely responsible for the accuracy and completeness of all data logged in OIT Harmony. Clinicians using the OIT Harmony clinician portal are responsible for manually reviewing and verifying patient progress summaries and logs before making clinical decisions. We exclude liability for clinical outcomes resulting from inaccurate data entries.
6. Account Eligibility & Security
Accounts must be created and maintained by a parent or legal guardian who is at least 18 years of age. You are responsible for maintaining the security of your credentials and notify us immediately of any unauthorised access.
7. Amendments & Re-Consent
We may update these Terms of Service. If terms change, you will be notified and prompted to review and re-accept the updated terms upon your next login or app load. Continued use of OIT Harmony is contingent upon your acceptance of the active terms.
8. Subscription, Fees and Payments
- Subscription Plans: We may offer OIT Harmony under various subscription tiers (including "Family Premium") as described on our pricing page or app store listing.
- Billing and Payment: If you subscribe to a paid tier, billing is processed via third-party platforms (e.g. Stripe, Apple App Store, or Google Play). You agree to pay all fees associated with your chosen plan in accordance with the billing terms in effect at the time of renewal.
- Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless cancelled before the renewal date through your account settings or application store dashboard.
- Refund Policy: Payments are generally non-refundable except as required under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable laws. If you believe you are entitled to a refund due to a service fault or major failure, please contact support at support@oitharmony.com.
- Fee Modifications: We reserve the right to modify subscription fees upon providing at least 30 days' notice. Continued use of the platform after the change constitutes acceptance of the new fees.
